It is the rare project that does not come to include some changes to the original scope of work. Whether those changes are documented as formal Change Orders, fully executed before any additional work gets started, is another story.
When it comes to work beyond the original scope, subcontractors almost always find themselves between a rock and a hard place: On one hand, the contract says they won’t get paid if they proceed with extra work without a formal Change Order, and on the other hand, they’re instructed to proceed immediately at the risk of being assessed damages for delay.
To survive and thrive in this environment, every subcontractor should have an ironclad process for getting paid and avoiding backcharges for changes in the work.
- Get it right the first time by inserting the right protections into the subcontract –both in the Changes in the Work provision and in your standard lien release
- Send the right emails and notices to insulate you from delay damages when a change in the work situation arises
- Protect your right to get paid even when you don’t have a fully executed Change Order
